Back in 2015, The State Of Texas created the Compassionate Use Program (CUP) which is administered through the Texas DPS. DPS operates a secure online registry of qualified physicians who can prescribe low tetrahydrocannabinol (THC) to patients with specific medical conditions.

The registry is called the Compassionate Use Registry of Texas (CURT).

CURT is designed to prevent more than one qualified physician from registering as the prescriber for a single patient. The registry is accessible to law enforcement agencies and dispensing organizations to verify patients of low-THC cannabis, and allows a physician to input safety and efficacy data derived from the treatment of patients for whom low-THC cannabis is prescribed.

DPS also manages the licensing of organizations that dispense low-THC cannabis to patients in the Compassionate Use Registry of Texas.

This means if you want to start a medical dispensary in Texas, you' will have to go through the process of getting approved by DPS and it starts with applying for a license to become a Compassionate Use Program organization.

On Friday (Jan. 13), the DPS Regulatory Services Division (RSD) announced that they are accepting NEW applications for Compassionate Use Program dispensing organization licenses. Applicants who have previously applied for a CUP dispensing organization license may reapply by submitting an updated application form (CUP-101). Application fees will be waived for applicants who are reapplying.

Applications for dispensing organization licenses may be submitted through the RSD Contact Us portal, using application form CUP-101. The application window will close at 5 p.m. CT on April 28, 2023.
